True, but fanfilms are often treated differently. Infringement is infringement is infringement... but most of the creators of fanfilms aren't getting slapped with Cease and Desist orders, are they? As long as they're not trying to profit, a blind eye is more often than not turned on the infringement. Now, if a comic book character was used in a porn, even a free porn one could download, that cease and desist order would come FLYING in. It has to do with the spirit and integrity of the source material.

WB indeed released a statement saying they would continue to monitor the use of fanfilms but would only choose to take action against those who try to profit from them film or if it defames the characer in someway.
