Script Based on Novel

This is my first post. I love films and hope to become a producer in the future. My question is:


There is an Japanese animation (2006) based from a novel made in 1967.
Since everything is a remix, how much "inspiration" can I get from the animation without getting sued?


I want to write a script based on the animation film and make a movie with real actors. The concept will be similar but more "western".

Any help?
 
If your script is based on the film, you may have to get permission; that said, if you were inspired to write a similar treatment, you may not need to get permission. That's my understanding, but I'm not really sure, because I'm just beginning to study entertainment law. Furthermore, since you seem to be from Brazil, which uses a different system of law than the Anglo-American one, you should speak to a local entertainment lawyer.
