Is Hercules copyrighted?

I'm assuming that Hercules is not copyrighted since he is a mythological person right?

Reason for asking is because I want to make a modern day Hercules film

Stories/characters published prior to 1923 are in the public domain. Since Hercules (aka Heracles) dates back to around 1200BC, I think you're pretty safe.
