Intellectual Property Protections

What if someone steals my Entry or parts of my Entry?

Talenthouse is definitely not OK with intellectual property violations and we are doing our best to eliminate and prevent clear cases of such infringement. Things like copyright violations aren’t good for anyone. This is especially true in the areas of film, fashion, photography, art / design, and music.

If your Entry or parts of it has been stolen, please bring it to our attention as soon as possible. We’ll investigate, and if there’s a clear case of property infringement, we’ll remove the offending Entries and suspend the user indefinitely.

However, there are cases where a certain amount of similarity is expected, especially between members competing in the same Invite. If you are directed by the host to use common concepts or pre-existing materials in your Entries such as music tracks, certain images or certain photographic models, you are not able to claim property rights in that concept or pre-existing materials. Similarly, if a member is the first to use a general concept and other members take up the use of that concept with a different implementation, this is allowable. The concept cannot be owned.

Basically, it boils down to this — concepts cannot be owned, but implementations can.
If you’re still unhappy with the resolution (and you can prove your ownership of the property in question) consider filing a DMCA takedown notice. But be warned — you’ll be liable for damages, including costs and lawyers or attorneys fees, if you materially misrepresent that an activity is infringing your property rights.

For more information, check out our Copyright Protection page here:http://bit.ly/aTxwEu
Please read our DMCA Notice carefully.

How are copyright transfers handled?

The transfer of copyright and other intellectual property rights are handled by the Invite rules.

Who owns what, and when?

Intellectual property is a serious issue.
On Talenthosue members sometimes agree to use owned (e.g. copyrighted materials) presented by the host for use in the Invite. In these cases, the member takes no property interest in the pre-existing property. After completing and submitting an Entry, the member owns the rights to the Entry (although not the rights to the host’s pre-existing property). This is true all the way up until a member’s Entry is selected as the Invite winner. Then, and only then, does the member agree to transfer their rights to that particular Entry over to the host. They do this by executing all of the documentation necessary to transfer the property and the host becomes the sole owner. It must be reiterated, however, that the member never gains any ownership interest in the host’s property. In other words, to use a non-winning Entry which contains a host’s property commercially, the submitting member must obtain the authority of the host. Talenthouse is not responsible for a member’s misuse or infringement upon a host’s property.

How do I know I'll get paid after transferring my intellectual property?

Typically Talenthouse will hold prizes before the Invite is launched. In other cases, we won’t let the host withhold the prize without good reason.

What is a licensed content declaration?

A licensed content declaration gives designers an opportunity to declare what third-party elements they’ve used in their designs.

If your design is 100% original, it shouldn’t effect you at all; however, if you’ve made use of third party elements, you must then enter the details of any third party materials (other than the materials provided by the host for use in the Invite itself) you’ve used.

If your design is not original, we reserve the right to remove it from the site. After all, Talenthouse helps generate and distribute unique creative content.
