I am an associate producer for a feature-length documentary right now in Post-Production. Part of the film highlights some artists' insights on drug use and drug culture.

In much of the footage we really want to use, many individuals are actually using real substances, namely Marijuana. Basically, I am wondering to what extent we may be able to use this footage. I absolutely do not want anyone in the film or working on the film to be incriminated for this footage.

Any advice on how to legally distribute this video content safely (especially in festivals)? Any information? Thanks!

This is definitely one of those questions that has an "Ask a lawyer" answer.

On Intervention the cameras document people shooting up, smoking, etc.

There's plenty of documentaries that show abuse. Just make sure you are documenting and not distributing or contributing. You can document anything.

But yes, consult an attorney.
